Banking and Insolvency
- We have advised Maybank Investment Bank Berhad, Malayan Banking Berhad and RHB Bank Berhad in respect of recovery of sums due under Redeemable Convertible Secured Notes 2002/2007 issued by Gula Perak Berhad with an aggregate nominal value of RM288 million.
- We are acting for a consortium of banks in respect of matters arising from winding-up of CNLT (Far East) Berhad. The principal amount due to Maybank Investment Bank Berhad, Malayan Banking Berhad, CIMB Bank Berhad and EON Bank Berhad by CNLT (Far East) Berhad under a Guarantee Facility Agreement is RM60 million.
- We are advising a Trustee for Noteholders on priorities between different groups of creditors and remedies arising from default of RM105 million Medium Term Notes issued by a private company.
- We are advising a Trustee for Noteholders on remedies arising from default of RM50 million Mudharabah Medium Term Notes issued by a public listed company.
- We are representing the Liquidators of a company in an appeal by the contributories to the Court of Appeal for an order to modify the decision of the Liquidators to sell the entire controlling block of shares and warrants in a subsidiary and to direct the Liquidators to distribute the shares in specie.
- We are advising on insolvency issues arising in the receivership and liquidation of various companies and making various applications to Court.
- We have successfully defended a Malaysian banking institution in a RM 65 mil claim for alleged breach of its loan obligations and succeeded in the financial institution’s counterclaim for RM 39 mil.
- We are defending an international Qatari company in Qatari Riyadh 16.5 mil bank guarantee dispute involving a Malaysian.
- Development company and Malaysian bank. The matter is still on going.
- We are defending a Malaysian financial institution on RM110 mil claim on alleged fraudulent misrepresentation. The matter is still on going.
