Construction

 

  • Acting for the main contractor in relation to a claim amounting to US $ 100 million with regard to a dispute arising from the construction of a power station project. We have advised clients on various aspects of the contract including technical issues and the claim prepared by their claim’s consultant.
  • Acting for the nominated international subcontractor who designed and built the curtainwall for the Kuala Lumpur Twin Towers, with regard to claims for additional time, non-payment of retention sums and prolongation costs. We act for the nominated subcontractor on five different contracts with a total contract sum of RM 300 million. This dispute is to be adjudicated in Singapore and in accordance with the Rules of the Singapore Arbitration Centre.
  • Acting in Court as counsel for a Japanese contractor, in the High Court of Malaya, with regard to the construction of the contact piers in the Kuala Lumpur International Airport project. Our clients are defending a suit commenced by the subcontractor. We are also advising clients on a suit commenced by them in the Singapore High Court.
  • Acting for a Japanese contractor with regard to disputes concerning the construction of a luxury apartment block, a hotel in Kuala Lumpur and a highway joint venture dispute.
  • Acting for the main contractor in a dispute with the subcontractor with regard to the construction of a water treatment plant, in particular, advising our client on the merits of the claims forwarded by the main contractor. 
  • Acting as counsel for the main contractor in regard to a dispute over the building and construction of the Pergau Dam in the North of Malaysia. This matter was resolved and resulted in a very favorable settlement for our clients.
  • Acting for a light railway systems company on the construction and the disputes between the parties with regard to the light railway system in Kuala Lumpur.
  • Acting for the main contractor, a French contractor on disputes and contractual position with regard to the Berjaya Star City project in Kuala Lumpur. The project was valued at approximately RM 1 billion.
  • Acting for the Japanese main contractor in a RM 15 million dispute with regard to the construction of a high rise office tower. The claim by the main contractor revolved on the failure of the Employer to carry out and supervise the piling and foundation works properly.
  • Acting for the main contractor, a public listed company in defending an action commenced by the subcontractor. This claim by the subcontractor in relation to the construction of a Hotel in Kuala Lumpur.
  • Acting for German contractors and consultants with regard to the construction of the cargo hangers in the Kuala Lumpur International Airport. The claim by our clients is for non-payment of the contract sum and for additional payment for the variation work undertaken by the contractor.
  • Acting for the developer with regard to the construction of a housing project in Kuala Lumpur. We advised the developer to determine the employment of the main contractor and further successfully set aside the injunction filed by the main contractor to prevent our clients from calling on the performance bond.
  • Acting for an international contractor and drafting the agreements with regard to the construction of an underwater pipeline of the west coast of Malaysia, and further advising on the rectification and remedial works and drafting the agreements for these works.
  • Acting for the main contractor and commencing proceedings in the High Court of Malaya against consultant engineers for negligently giving advice with regard to design specifications and as built drawings.
  • Acting for the piling subcontractor a french company, and commencing legal proceedings against the main contractor for the failure to make payment of the contract sums, refusal to release retention sums and make payment for additional works undertaken.
  • Acting for an international engineering company, with regard to the construction and installation of two station filter separators in a compressor station in the south of Malaysia.
  • Representing an Australian contractor in an arbitration involving claims and counterclaims exceeding RM100 million, arising from the construction of the Kuala Lumpur International Airport catering facility.
  • Advising an international consortium on a claim arising from the construction of a power station.
  • Acting for a Japanese contractor in disputes concerning the construction of a luxury apartment block, and an office tower in Kuala Lumpur.
  • Acting for the developer in disputes with the contractor for the construction of condominiums in Kuala Lumpur.
  • Acting in a commercial arbitration in Singapore between a Bruneian and a Malaysian company in claims involving sums in excess of RM30 million.
  • Acting for the contractor in arbitration involving claims and counter-claims exceeding RM200 million, arising from the construction of a cable-stay bridge.
  • Representing both developers and contractors in arbitrations and in litigation arising out of the construction of office buildings.
  • Representing a developer defending claims by a contractor arising out of the construction of a hotel, shopping complex, and office tower.
  • Representing the owner in an arbitration arising out of a contract for the upgrading of a waste water treatment plant.
  • Representing a federal government authority in an arbitration to defend claims by a contractor arising out of the construction of a new road.
  • Advising a contractor in respect of a dispute with the federal government arising out of the construction of a new road.
  • Advising a contractor in respect of a dispute arising out of the construction of a golf course.
  • Acting for a developer in an arbitration with a contractor arising out of the construction of a 5-star hotel.
  • Representing the owner in respect of a dispute arising out of the construction of a petrochemical facility.
  • Advising the developer of a cinema cum entertainment centre in respect of disputes with the contractor.
  • We are acting for a Resort company against a state Government to set aside a land acquisition that threatens the eco-tourism project at the resort which is valued at RM 250 million.
  • We are acting for a public listed company in challenging the MASTERPLAN KL DCP 2020 which threatens to zone the public listed company from a commercial plot into a green area.
  • We have acted for MWE in an inter-connected construction site accident cum construction dispute. In the accident case, a falling form steel structure killed a passer by. MWE was charged for an offence and we successfully secured an acquittal.
  • We are acting for a multinational Japanese listed construction company to defend a claim for RM 150 million for alleged misrepresentation.
