Corporate Disputes

 

  • Instructed by a leading regional information and communications group to defend a claim for alleged conspiracy, in perhaps the single largest suit brought in Malaysia so far - RM13 billion. This is pending.
  • Appeared for the largest bank and financial group in Malaysia in the Federal Court on a point that has not been decided before by it - whether a provision for an indemnity in a contract takes away the common law right to damages, where there is a breach. This was successful. It is reported in [2007] 1 AMR 257 (FC).
  • Instructed by a multinational Japanese listed construction company to defend a claim for RM150 million for alleged misrepresentation. This is pending.
  • Instructed by a large Malaysian investment bank to defend a claim for RM150 million for alleged breach of contractual and tortious duties as adviser to a proposed restructuring. This is pending.
  • Successfully defended an offshore financial authority in an appeal against its decision to revoke consent for an offshore private fund.
  • Appeared for a subsidiary of a leading regional information and communications group in the Court of Appeal, on a point that has not been decided before by it - whether an appeal against the refusal of an injunction is academic, where the event sought to be restrained has since happened. This was successful.
  • Acting for the main contractor in relation to a dispute arising from the KLIA catering facility, amounting to approximately RM 100 million. This matter is currently in arbitration.
